Terms and Conditions of Sale

1. Summary of the main terms and conditions of sale

1.1 These General Terms and Conditions govern the distance selling service of Products (hereinafter the Service), on the website Perrino Pregiata Pasticceria (hereinafter the "Site") by Perrino Eventi Srl (hereinafter the "Seller").

1.2 Before making your purchase, we invite you to read these General Terms and Conditions of Sale in full.

Below we indicate the main terms and conditions of the Service:

• Shipping zones: Products are shipped from Italy to Italy, Europe and Extra Europe.
• Shipping costs:
  • Italy: shipping costs applied for orders up to €50, free shipping for orders over €50
  • Europe: €25 for orders up to €180, free shipping for orders over €180
  • Extra Europe: fixed cost of €60 for all orders
• Price and presentation of products: Product prices are expressed in Euros and include VAT. The images of the Products offered for sale on the site may not correspond to the real ones due to the Internet browser and monitor used. Within the Site you can purchase food and non-food goods.
• Purchase methods: To purchase one or more Products you must carefully fill out and transmit to the Seller electronically a Purchase Order (which is a binding contractual proposal) which summarizes the information on the essential characteristics of each Product ordered and its price, payment methods, delivery methods, and shipping costs. By transmitting the Purchase Order you confirm that you know and accept the General Terms and Conditions of Sale.
• Order fulfillment: Following receipt of the Purchase Order, the Seller transmits confirmation of your acceptance or, if applicable, indicates the reasons why your order will not be processed. In case of unavailable products, the Seller will contact you to offer a refund or product exchange. Preparation and shipping times vary based on product availability: for readily available products, shipping generally occurs within 2 business days from successful payment registration; for products requiring preparation or not immediately available, times may be longer and you will be promptly informed of estimated order fulfillment times.
• Warranty: All Products available on the site are guaranteed for conformity defects as provided by Italian jurisdiction. To use warranty assistance, you must keep the fiscal receipt (or invoice) attached to the purchased product.
• Right of withdrawal for non-food goods purchased on our site: You have the right to withdraw from the contract concluded with the Seller, without any penalty and without specifying the reason, within fifteen (15) working days from the day of receipt of the Products purchased on the site. On how to exercise this right, see the following articles on the return and exchange policy. Please note: customers who purchase with a VAT number cannot exercise the right of withdrawal.
• Right of withdrawal for food goods purchased on our site: In line with the Consumer Code (art. 52, art. 58, art. 59), the right of withdrawal is not provided for goods that risk deteriorating or expiring rapidly and for that category of products that are not suitable for return for hygienic reasons.

2. Product information and prices

2.1 All information on the essential characteristics of the Products is provided within the identification sheet of each of them.

2.2 Product prices are expressed in Euros, including VAT and do not include shipping costs, which vary based on the destination and order amount as follows:

• Shipping to Italy: shipping costs applied for orders up to €50, free shipping for orders over €50
• Shipping to Europe: €25 for orders up to €180, free shipping for orders over €180
• Extra Europe shipping: fixed cost of €60 for all orders

The prices shown on the Site may be subject to updates, we therefore invite you to check the final sale price before submitting the relevant Purchase Order.

3. Methods of concluding the purchase contract

3.1. To conclude the purchase contract for one or more Products on the site, after selecting the Product or Products of your interest, you must first fill out and transmit to the Seller electronically a Purchase Order for the selected Products in electronic format (which is a contractual proposal), indicating the Products you are requesting to purchase, the chosen payment method and some necessary personal data (hereinafter the Purchase Order).

3.2. The Purchase Order consists of a "Personal Data" screen in which you must indicate the personal data necessary for delivery and a screen for selecting and activating the chosen payment method (as better indicated in article 4 below). The Purchase Order also contains a summary: of information on the essential characteristics of each Product ordered and its price, the payment methods available to complete the Purchase Order and shipping costs.

3.3. The Purchase Order will be stored in our database for the time necessary to fulfill orders (and in any case within the legal terms). You can access your Purchase Order at any time to monitor its status by connecting to the Site and accessing the "my orders" section.

3.4. The contract is concluded when the Seller receives and accepts, electronically, your Purchase Order, after verifying the correctness of the data relating to your order. The Seller may not proceed with Purchase Orders: (a) that do not provide sufficient guarantees of solvency or that are incomplete or incorrect, or (b) in case of unavailability of the Products (if they are no longer available or for sale). In these cases, the Seller will inform you promptly (and in any case within thirty days from the day following the one in which the Seller received your Purchase Order) by email that the contract is not concluded, specifying the reasons and offering you a refund or an equivalent product exchange. If you have already paid the price of the Product and shipping costs and you choose a refund, you will be refunded the corresponding amount (as better indicated in article 9 below).

If the Seller intends to conclude the contract, it will send you, by email, a receipt of the purchase order, containing a summary of the information relating to your Purchase Order and the estimated preparation and shipping times.

4. Payment methods

4.1. When submitting the Purchase Order you will be asked to choose one of the following payment methods for the Products:

• a) Bank transfer in advance to the Seller;
• b) Credit card;
• c) PayPal.

4.2. In case of payment by bank transfer in advance, you will receive an indication of the bank details on which to make the transfer. We invite you to verify the completeness and correctness of the references and essential elements of the bank transfer. Missing data or the absence of necessary references may cause delays in order fulfillment and subsequent delivery of the Products.

4.3. In case of purchase using the Credit Card / PayPal payment method, at the end of the Purchase Order completion procedure, you will be automatically directed to the IT platform owned by PayPal which will manage the entire payment transaction. Here you can choose whether to pay by credit card or with your PayPal account.

In case of payment with:

• your PayPal account: the amount relating to the order will be charged to your PayPal account upon receipt of the order by the Seller.
• a credit card: the amount relating to the order will be charged to your credit card.

In no case can the Seller be held responsible for any damage, direct or indirect, caused by delays in the failure to release the amount committed by PayPal.

At no stage of the purchase procedure on the site can the Seller access your financial information or know it. The entire transaction is managed in any case by PayPal which will send you a confirmation email for each transaction.

5. Shipping and delivery of Products

5.1. The shipment of the Products is carried out to the address indicated in the Purchase Order only after the regular registration of payment for the order. No deliveries will be made to post office boxes. Preparation and shipping times vary based on the type and availability of the products ordered. For readily available products, the Seller will generally ship within 2 business days from receipt of payment. For products requiring special preparation or not immediately available in stock, fulfillment times may be longer; in this case, you will be promptly informed of the estimated preparation and shipping times upon order confirmation.

5.2. Shipping destinations and related delivery times are as follows:

• Italy: Deliveries will be completed on average within 2-3 working days from the shipping date, excluding Saturdays, Sundays and holidays in general.
• Europe: Deliveries will be completed on average within 5-7 working days from the shipping date, excluding Saturdays, Sundays and holidays in general.
• Extra Europe: Deliveries will be completed on average within 7-15 working days from the shipping date, excluding Saturdays, Sundays and holidays in general.

The delivery times just indicated are to be considered purely indicative. The Seller will in no way be responsible for any delivery delays due to causes not attributable to it.

5.3 The shipment will be accompanied by an invoice / receipt issued by the Seller.

6. Product quality and warranties

6.1. You are aware and accept that the images and colors of the Products offered for sale on the site may not correspond to the real ones due to the Internet browser and monitor used.

7. Right of withdrawal for non-food goods

7.1. You have the right to withdraw from the contract concluded with the Seller, without any penalty and without specifying the reason, within fifteen (15) working days from the day of receipt of the Products purchased on the site.

To withdraw from the contract you must first send an email to the address: info@perrino.it to obtain return authorization and all the necessary instructions to proceed with the withdrawal.

Shipping costs will be at your expense, including responsibility in case of loss or damage to the Products.

7.2. The right of withdrawal - in addition to compliance with the terms and methods described in the previous point 7.1 - is understood to be correctly exercised if the following conditions are also fully respected:

• a) the Products must not have been used, opened, worn, washed or damaged;
• b) the identification tag (if present) must still be attached to the Products;
• c) the Products must be returned in intact packaging, adequately sealed with intact, original and complete packaging and contents;
• d) returned Products must be sent to the Seller in a single shipment. The Seller, in fact, reserves the right not to accept Products of the same order, returned and shipped at different times.

7.3. If the right of withdrawal is exercised following the methods and terms indicated in this paragraph 7, the Seller will refund any amounts already collected for the purchase of the products.

The amounts will be refunded to you in the shortest possible time and, in any case, within thirty (30) days from the date on which the Seller became aware of the exercise of your right of withdrawal, we will activate the refund procedures pursuant to the following paragraph 9, once the correct execution of the terms and conditions indicated above has been verified.

7.4. If the methods and terms for exercising the right of withdrawal are not respected, as specified in this paragraph 7, you will not be entitled to a refund of the amounts already paid to the Seller; however, you may recover, at your expense, the Products in the state in which they were returned to the Seller. Otherwise, the Seller may retain the Products, in addition to the amounts already paid for their purchase.

8. Right of withdrawal for food goods

In line with the Consumer Code (art. 52, art. 58, art. 59), the right of withdrawal is not provided for goods that risk deteriorating or expiring rapidly and for that category of products that are not suitable for return for hygienic reasons.

9. Refund times and methods

9.1. After the return of the Products, the Seller carries out the necessary checks relating to their compliance with the conditions and terms indicated in paragraphs 7.1. and 7.2. If the checks are completed successfully, the Seller sends you, via email, the relative confirmation of acceptance of the Products thus returned.

9.2. Whatever payment method you used, the refund procedure is activated by the Seller in the shortest possible time and in any case within thirty (30) days from the date on which the Seller became aware of the exercise of your right of withdrawal after verification of the correct exercise of your right of withdrawal and acceptance of the returned Products.

9.3. If there is no correspondence between the recipient of the Products indicated in the Purchase Order and the person who made the payment of the amounts due for their purchase, the refund of the amounts, in case of exercise of the right of withdrawal, will be made by the Seller, in any case, to the person who made the payment.

10. Force majeure

The Seller will be relieved of any contractual obligation to do or deliver and will not be required to pay any compensation in case of force majeure events that prevent the fulfillment of obligations placed on it, such as by way of example only riots, insurrections, social unrest, telephone or IT failures or serious damage to the security and operation of the internet, strikes and impossibility of supplying Products and materials.

11. Applicable law and dispute resolution

11.1 The General Terms and Conditions of Sale are governed by Italian law and in particular by Legislative Decree 6 September 2005 n. 206 (Consumer Code) with specific reference to the regulations on distance contracts and by Legislative Decree 9 April 2003 n. 70 on certain aspects concerning electronic commerce.

12. Periodic update

The General Terms and Conditions of Sale are modified from time to time also in consideration of any regulatory changes. The new General Terms and Conditions of Sale will be effective from the date of publication on the site. We therefore invite you to periodically consult this section to check for any updates.
